For apartments that are under purchase contracts, the terms when signing transfer agreement will be more detailed and there will be more paperworks than for apartments that already have ownership certificate issued. What are the conditions for purchasing apartments?
Before buying/selling an apartment, buyers and sellers need to check the following conditions to know if they can transfer it.
♦ The Seller (apartment owner)
Make sure the apartment is not in dispute with anyone and the person whose name is on the purchase contract (or ownership certificate) is legal.
In case the seller (homeowner) is borrowing an amount from a bank, the loan needs to be settled before beginning the transaction.
Usually, once the buyer made a deposit to show good-faith, the seller will carry out the paperwork to get the Sales Contract or certificate from the bank.
♦ Buyer
- Vietnamese nationality (If you are a foreigner, the conditions are if that the apartment still has room for foreigners and the buyer has all the necessary documents according to Vietnamese law).
- If the buyer takes out a loan, they need to contact the bank first so they can check whether the apartment they are buying is eligible for a loan or not (many apartments without certificate will not be supported by the bank) and they will check if the buyer’s profile is qualified for a loan or not.
(Note: This step is very important because there are many people who have made a deposit but when they go to the bank they refuse to lend money because they don’t have money

After viewing the apartment, the customer agreed to buy it, but when he inspected the house closely, he saw that the ceiling in the dining room was water-logged. After asking the homeowner, they found out that it was leaking from the apartment above and seeping down, then the buyer requested the waterproofing to be done before buying it.
When I asked the homeowner, I found out that 2 years ago, he had gone to the house above to open the door for a technician to fix it once, but it still happened again, and the homeowner upstairs felt annoyed that they had many children and grandchildren and had to turn off the water for a long time. So if he ask again, they will definitely not accept it anymore. This time, the buyer went to the apartment manager to ask for intervention. Initially, the Manager called but Aunty did not answer the phone. People also heard that Aunty was very difficult to deal with. After asking a few times, he also quit because of this inconvenience (helping but not getting anything in return, sometimes even being scolded by the neighbors).
At this point, both the buyer and the seller are truly at a loss, reaching a deadlock. At that time, I proposed this: Let me go up and talk to Aunty, maybe he’ll be surprised. At first, Uncle reluctantly nodded because he thought that if the buyer couldn’t get the request, how could the Broker even succede?
Knocking on the door with all the courage and sincerity, Aunty opened the door with an annoyed look in her eyes. Do you have something to say…? After some bout of exchange, she calmed down and confided that her family has 3 grandchildren, 1 aunt and 1 child, how could the worker turn off the water for a day, then.
I said: if possible, the buyer’s workers will do their job for about half a day, during the process, the whole family can stay temporarily downstairs to live (of course the apartment below is empty and more beautiful than the one they are staying). In addition, all costs will be borne by the buyer. I added that this would be good for her, because if left for a long time, the wall would rot and the wall ươuld collapse, which is very dangerous for her family…
After listening, she thought it was reasonable and then I asked her about her life. After listening, I realized she was endearing, unlike the rumors. She works hard to save money. In addition to taking care of her grandchildren, she also buys food for abandoned dogs and cats, and sometimes even brings them home to feed them. Then Aunty and I bid each other farewell with affection and sympathy.
So, the difficult case for both the buyer and seller has been resolved. From then on, both of them look at me with different eyes. When the day came when we went to the notary office, everyone looked happy.
